2. Acceptance of terms

By accessing or placing an order on polos.ro, you confirm that you have read, understood, and agree to be bound by these Terms of Service, our Privacy Policy, and our Return & Refund Policy. If you do not agree, please do not use our website. We reserve the right to update these terms at any time. Changes will be published on this page with an updated date.

3. Who can use our website

Our website is intended for users aged 16 and over. By placing an order, you confirm that you are at least 16 years old. If you are placing an order on behalf of a company, you confirm that you are authorized to do so and that the company agrees to these terms.

4. Products & information

We sell physical products and gift cards through polos.ro. We make every effort to display product information, descriptions, and images as accurately as possible. However:

  • Product images are for illustrative purposes and may differ slightly from the actual product due to manufacturer changes
  • Product descriptions may be incomplete — we recommend contacting us for specific details before ordering
  • We reserve the right to modify or discontinue any product without prior notice

5. Prices & VAT

All prices displayed on polos.ro include VAT as required by Romanian law. Prices may be changed at any time without prior notice, but the price confirmed in your order is the price you will pay. In the event of an obvious pricing error (e.g. a price significantly below market value due to a technical error), we reserve the right to cancel the order and notify you. No surcharges are applied for standard payment methods.

6. Orders & contract formation

Placing an order on polos.ro does not constitute a binding contract. The sale contract is formed at the moment we issue your fiscal invoice. Until that point, we reserve the right to:

  • Decline or cancel an order if a product is out of stock
  • Offer an alternative product of similar specifications
  • Cancel an order resulting from a pricing error, with full notification to you

Order confirmation is sent by email or SMS. If you do not receive confirmation within 24 hours, please contact us at comenzi@polos.ro.

7. Payment

We accept the following payment methods:

  • Credit/debit card (processed securely by [Stripe / PayU / Netopia])
  • Cash on delivery (where available)
  • Bank transfer (for selected orders)

We do not store your card details. For online card payments, your card is charged only after order confirmation. If a product becomes unavailable after payment, a full refund will be issued with no additional charges.

8. Delivery

We deliver through trusted courier partners [e.g. FAN Courier / DPD / Cargus / Sameday]. Estimated delivery times:

  • Standard: 2–5 business days
  • Remote areas may take longer
  • Maximum legal delivery time: 30 days from order confirmation

Delivery costs and any applicable free shipping thresholds are displayed at checkout. Ownership of goods transfers to you upon physical delivery, confirmed by signing the courier's delivery document. We are not responsible for delays caused by the courier, customs, or force majeure events.

Our maximum liability for non-delivery or incorrect delivery is limited to the value of the amounts paid by you for that order. Penalties and interest are excluded.

9. Product warranty

All products sold on polos.ro benefit from a 2-year legal guarantee in accordance with Romanian law (GEO no. 140/2021 and Law no. 449/2003). If a product is found to be non-conforming, you are entitled to repair, replacement, price reduction, or contract termination. You must notify us of any defect within 2 months of discovering it. Commercial warranties (if any) are specified per product and do not replace your statutory rights.

10. Gift cards

Gift cards sold on polos.ro are subject to the following conditions:

  • Gift cards cannot be exchanged for cash
  • Lost or stolen gift cards cannot be replaced
  • Gift cards are not subject to the 14-day right of withdrawal once redeemed
  • We reserve the right to cancel a gift card in cases of fraud or misuse

11. Promotions & discounts

Promotional offers and discount codes are valid for the period stated in the promotional material and while stocks last. Only one discount code may be applied per order unless otherwise stated. We reserve the right to withdraw or modify promotions at any time.

12. Intellectual property

All content on polos.ro — including logos, images, text, product descriptions, and design — is the property of NINOS ONLINE CORP S.R.L. or its licensors and is protected by Romanian and EU intellectual property law. You may not reproduce, copy, or distribute any content without our prior written permission.

13. Prohibited use

You agree not to use polos.ro to:

  • Engage in fraudulent, illegal, or abusive activities
  • Attempt to access other users' personal data
  • Interfere with the website's performance or security
  • Place orders with false information

Any fraudulent activity may be reported to the competent Romanian authorities.

14. Limitation of liability

To the maximum extent permitted by Romanian law, NINOS ONLINE CORP S.R.L. is not liable for indirect, incidental, or consequential damages arising from the use of polos.ro or products purchased on it. Our total liability is limited to the value of the order in question. We are not responsible for temporary unavailability of the website due to technical issues or maintenance.

15. Force majeure

Neither party shall be liable for failure to fulfill its obligations due to force majeure events — unforeseeable circumstances beyond the parties' control, as defined by Romanian law in force at the time of the event (including natural disasters, pandemics, supply disruptions, or government restrictions).

16. Dispute resolution

In case of a dispute, we encourage you to contact us first at info@polos.ro so we can resolve the matter amicably. If that is not possible, disputes will be settled by the competent Romanian courts.

You may also use the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr. For alternative dispute resolution in Romania, you may contact ANPC (National Authority for Consumer Protection) at www.anpc.ro.

17. Applicable law

These Terms of Service are governed by Romanian law. Applicable legislation includes OUG nr. 34/2014, Law no. 365/2002 on e-commerce, Law no. 193/2000 on unfair contract terms, Law no. 449/2003 on product guarantees, and GEO no. 140/2021 on sale of goods conformity.
